These Website Terms and Conditions (“Terms”) govern your access to and use of expressrr.com and any public-facing webpages, forms, content, or features made available by Rapid Records LC, doing business as Express Records (“Express Records,” “we,” “us,” or “our”) (collectively, the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Website Information Only

The Website provides general information about Express Records and its medical and billing record retrieval services. Website content is not legal, medical, tax, or other professional advice and should not be relied upon as such. No attorney-client, healthcare provider-patient, fiduciary, or other professional relationship is created through use of the Website.

2. Separate Service Agreements

The Website does not itself create a customer relationship or obligate Express Records to accept or perform a records request. Our services for customers are governed by a separate written services agreement, business associate agreement, order, authorization, or other applicable documentation. If these Terms conflict with an applicable written agreement concerning paid services, the written agreement controls with respect to those services.

3. Eligibility and Authority

You must be at least 18 years old and legally capable of agreeing to these Terms. If you use the Website for a business or organization, you represent that you are authorized to act for it and bind it to these Terms.

4. Acceptable Use

You may use the Website only for lawful purposes. You may not:

  • violate any law, regulation, court order, authorization, privacy right, or third-party right;
  • submit information or a request that is false, misleading, fraudulent, unlawful, or unauthorized;
  • attempt to gain unauthorized access to the Website, an account, system, network, or information;
  • interfere with the Website’s operation or security, introduce malware, overload infrastructure, or circumvent access controls;
  • scrape, crawl, harvest, copy, or use automated means to access the Website except as allowed by us in writing or by standard search-engine indexing;
  • impersonate another person or misrepresent your affiliation or authority;
  • reverse engineer or attempt to derive source code from Website software, except where a restriction is prohibited by law; or
  • use Website content or data to build a competing service or for unauthorized commercial solicitation.

We may suspend or block access when we reasonably believe these Terms have been violated or when necessary to protect the Website, our users, or others.

5. Information You Submit

You are responsible for the accuracy, lawfulness, and completeness of information you submit through the Website. You represent that you have all rights, permissions, and authority necessary to provide that information and to authorize its use for the purpose submitted.

Do not submit medical records, protected health information, Social Security numbers, payment-card details, or other highly sensitive information through a general website contact form. Use only the secure submission method designated by Express Records for records requests or sensitive information.

You grant Express Records a nonexclusive right to use information you submit as reasonably necessary to respond to you, provide requested services, operate and secure the Website, and comply with law, subject to our Privacy Policy and any applicable written agreement.

6. Privacy

Our collection and use of personal information through the Website are described in our Privacy Policy. By using the Website, you acknowledge that you have reviewed that Policy.

7. Intellectual Property

The Website and its content, including text, graphics, logos, designs, photographs, videos, software, and compilations, are owned by or licensed to Express Records and are protected by intellectual-property laws. Subject to these Terms, Express Records grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for its intended business informational purposes.

Except as permitted by law or with our written consent, you may not reproduce, modify, distribute, publish, display, sell, license, create derivative works from, or commercially exploit Website content. “Express Records” and associated names, logos, and marks may not be used without prior written permission.

8. Third-Party Links and Services

The Website may link to or integrate with third-party websites and services. We do not control and are not responsible for their content, availability, security, terms, or privacy practices. A link does not imply endorsement. Your use of a third-party service is governed by that provider’s terms.

9. Website Availability and Changes

We may modify, suspend, or discontinue any part of the Website at any time. We do not promise that the Website will always be available, uninterrupted, secure, or error-free, or that content will always be complete, accurate, or current. We may correct errors and update content without notice.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXPRESS RECORDS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED AVAILABILITY.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAPID RECORDS LC DBA EXPRESS RECORDS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

These limitations do not apply to liability that cannot lawfully be excluded or limited. Separate service agreements may establish different remedies and limitations for paid services.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Rapid Records LC DBA Express Records and its owners, officers, employees, contractors, agents, and affiliates from claims, liabilities, damages, losses, judgments, and reasonable costs, including attorneys’ fees, arising from your unlawful or unauthorized use of the Website, your violation of these Terms, or information you submit in violation of another person’s rights. This section does not require indemnification for our own negligence or misconduct where prohibited by law.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Subject to any applicable written service agreement, any action arising from the Website or these Terms must be brought in a state or federal court with jurisdiction in Weber County, Utah, and each party consents to personal jurisdiction and venue there. Nothing in these Terms prevents either party from seeking appropriate injunctive or equitable relief.

14. Electronic Communications

When you contact us electronically or use a Website form, you consent to receive responsive and service-related communications electronically. You are responsible for maintaining a current email address and for safeguarding any account credentials. Marketing messages, if any, remain subject to applicable consent and opt-out requirements.

SMS/Text Messaging Terms

If you provide your mobile number and affirmatively consent to receive text messages from Express Records, you authorize us to send the categories of messages described at the point of consent, which may include service-related, account, customer-support, or promotional messages. Consent is not a condition of purchasing services. Message frequency may vary. Message and data rates may apply.

You may opt out at any time by replying STOP to a message. After opting out, you may receive one confirmation message. Reply HELP for help or contact us at mail@expressrr.com or (801) 471-2002. Wireless carriers are not liable for delayed or undelivered messages. You represent that you are the subscriber or customary user of the mobile number provided and agree to notify us if that number changes.

Our use of mobile contact information and text-messaging consent is described in our Privacy Policy. We do not share text-messaging originator opt-in data or consent with third parties for their marketing or promotional purposes.

15. Changes to These Terms

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively when posted unless a different date is stated. Your continued use of the Website after the effective date constitutes acceptance of the revised Terms.

16. General Provisions

If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a business transaction or by operation of law. These Terms, together with the Privacy Policy and any applicable written agreement, constitute the applicable agreement concerning Website use.
